To be fair to Biden, he's actually not entirely wrong for a change. There are generally two schools of thought on the Constitution:
1) Originalists, like Scalia, who think that the Constitution should be interpreted strictly based on what the founding fathers intended when the document was written
2) Living constitutionalists contend that constitutional law can and should evolve in response to changing circumstances and values
The problem with the latter is that it often becomes a vehicle for spontaneously conjuring Constitutional support for things
Changing the Constitution to fit the times is what the amendment process is for.
Interpreting the facts of a particular case relative to the Constitution says is what the Supreme Court is authorized to do.
If the society changes, it is fully within the rights of the states to call a Constitutional convention and amend the document - as they did with Prohibition and then determined that was a fucktard move and repealed it via the same process.
The "living" constitutionalists are pinheads like Cho Bai Den.

“Truth be told, this was literally my first time voting, and I voted for you [Biden] and I feel disappointed right now. I don’t understand,” she said. “I thought he was going to talk for the American people, basically, and not for himself,” she said.
