So the Ninth Circuit held today, by a 2-1 vote. I tentatively think the majority got it right as a matter of First Amendment law and statutory interpretation, though I think such statutes ought to be written to include some privacy exceptions as to gender identity and not just sex.

I agree completely. I also think the Plaintiffs had far better arguments for challenging the agency, but their activist law firm wants to give the SCOTUS a First Amendment avenue to upend established principles yet again. 5-4? That would be my guess. I wouldn't bet the ranch on the outcome.

You seem to be confused about who and what I defended. Hint: it wasn’t the state agency. But Courts are only supposed to decide the questions they have jurisdiction to decide and that they have been asked to decide. Like Gasbag’s favorite Constitutional lawyer, I think the Court got the correct answer to the question it was asked.
