You think this was a comment on the lower court's opinion. It wasn't.
The federal circuit simply stayed the order until they can consider the parties' briefing, which will be submitted on an accelerated schedule beginning next week.
Preserving the status quo isn't that unusual for a matter that will be taken up again immediately. It is quite possible that the lower court would have stayed the matter as well. They had not yet ruled on the stay request when this came down.
You really should read the opinion, so you can know what you're talking about . . . for a change.
