No. He was killed while creating chaos, while carrying a weapon and 2 magazines, while others where blowing whistles creating more chaos, wrestling with 28 year old guys with guns, in a situation he was instructed to go to by the his commanders. He was a foot solider and didn't know it. His commanders couldn't be happier with the outcome.

Gun!, then a shot is fired other officers by case law don't have to somehow verify, they will shoot you. Fully acceptable for them to draw that conclusion it's established case law.
