I had a feeling the cop didn't shoot just for fun but how many shots were fired? The burden for prosecuting a cop is obviously higher than a civilian. The key will be about the alleged struggle in the car and if the cop was justified in using deadly force.
Regardless, bad things can happen when you break the law and rob a convenience store (such as encountering a cop who is more willing than other cops to use his gun). That's why I work to buy my swishers rather than stealing them:
