The purpose of the trial is determine whether they are victims or perpetrators. If the court were to allow them to be called "victims" that would be prejudicial to the defendant. Their status hasn't been established yet. The fact that Hondo is too stupid to understand this is hardly shocking, the fact that I'm hearing people who are supposedly attorneys who don't appear to understand this just explains further how the Dazzler was able to get a law degree.
