BTW the federal standard for an Injunction is that the moving party (Plaintiff) proves that they are "likely to succeed on the merits at trial". Abbott Labs. v. Sandoz, Inc., No. 2007-1300, 2008 WL 4636167 (Fed. Cir. Oct. 21, 2008). In this case he has ruled that the States are "Likely" to prove that Obama's Executive Order is Unconstitutional.
