Yes, the president can and has done that. Like any appointee, it has to be approved by the Congress . See Nixion naming Ford VP when Agnew resigned. Ford was never elected president or Vice President.
So isn’t that a strong reason why this scenario would never happen in a 50/50 senate? You’d need the VP to break the tie on a nomination for a VP.
Yeah, she is VP until she resigns, dies, impeached or becomes President due to a presidential vacancy. So, if Harris becomes president because the dementia patient resigns or replaced under the 25th amendment the VP spot is vacant and there is no VP to break a Senate tie breaker on any 50-50 split. Same thing if Kameltoe resigns. No VP to exercise the VP tie breaker vote as set out in the Constitution.
If Harris is president and can’t get her own VP in there, then the position remains. A vacant until the election. (See LBJ). If Harris is then removed from office, the speaker of the house is then president.
