All Trump's appointments are private citizens and the federal bureaucracy runs on independent contractors and non-Congressional appointees - like John Kerry, Special Envoy for Climate Change. Elon is not making the changes. They are all approved by Trump, who is the Chief Administrate Officer over all the federal administrative bureaucracies. Some judges say a lot of things. Four Supreme Court justices said the a private movie about Hillary was illegal. Some say that owning a rifle with a muzzle flash suppressor is illegal. Some judges say that discriminating based on race and sex is legal. Some say that the death penalty is illegal. The Constitution isn't that hard to read.
