Sure, but the political optics of appointing Gaetz after some of us were sure that Smith was an illegal appointee are bad.
The statute seems to be clear that both Smith and Gaetz aren’t eligible. The Smith case moving to Florida after a DC indictment is all that stopped dems from ignoring the appointment until SCOTUS would have overruled it.
It makes sense that a federal prosecutor should have to pass some sort of federal confirmation. State bars aren’t good enough for me.
