Yeah not a surprise that witness accounts are horribly inaccurate.
HOWEVER. Don't see how shooting someone could be reasonable just because they get out of their car and are gesticulating at your passenger window- large, black, and scary or not.
Just because they don't file charges right away doesn't mean they never will.

pretty sure in LA you can fire at someone who approaches your car aggressively // if you fear you're in imminent danger
the dude is an ex cop + the witness statements seem pretty bullshitish (broad daylight, dude gets out of car and puts additional holes in him? Says a Hollywood movie line before capping him? The witness(es) were close enough to hear this and weren't, you know, running for their lives?)
make sure you rush to judgment though, definitely won't have your foot in your mouth later
